DIVORCE A.K.A. DISSOLUTION OF MARRIAGE
You or your marital partner wants to end your marriage. One of you, with or without the assistance of legal counsel, files a petition for dissolution of marriage. Contrary to urban myth, your marriage will not automatically terminate by operation of California Law, upon the mere passage of 6 months + 1 day after you or your spouse files for divorce.
If you are a party who gave up your career to raise several children, over the course of a 10 + year marriage; or if you have serious health problems which have disabled you from working, you are, in most cases, going to need as much spousal support as possible to transition into your new life in the event of a divorce.
CHILD CUSTODY AND VISITATION
Every divorce involving minor children, or “parentage action” (i.e. where the parents of a child are unmarried), should include legal and physical custody orders relative to the children.
Raising children is expensive. If your marriage or non-marital relationship is ending, in most cases, you should have our firm help you obtain court-ordered child support.
COMMUNITY VERSUS SEPARATE PROPERTY
When your marriage ends, you can ask the court to divide your “community property” acquired during marriage. Hopefully, you and your spouse will be able to reach an agreement as to what assets and debts of your marriage are community, and divide them equally, without the court being the decision maker.
